Thai teen Nitcharee Peneakchanasak lost her legs in an accident at Ang Mo Kio MRT station in 2011 when she was just 14 after she had fallen onto the tracks and her legs were run over by a train.
She had already lost the lawsuit claiming damages from train operator SMRT and the Land Transport Authority (LTA) earlier this year.
On Wednesday (Oct 1), the Court of Appeal has dismissed her appeal too.
She sued SMRT and LTA for S$3.4 million, saying they had breached their duty of care in negligence, and failed to ensure the station was reasonably safe.
The High Court dismissed her claim with costs in January this year, noting that the MRT station was not congested at the time of the incident, and that there was no additional manpower needed for patrols.
The judges presiding over the appeal on Wednesday said the incident was a tragedy, but they also agreed with the earlier judgment that Ang Mo Kio MRT station had been reasonably safe at the time of the incident.
