"As we approached the scene it became apparent there was a drug raid going on," said Marlon Kautz, a member of a volunteer group called Cop Watch.
"They grabbed me, put my hands behind my back and tried to forcefully pry the phone out of my hands and eventually they were able to," said Kautz.
Kautz said the video of the incident was ruined while police had the phone, but this week the city of Atlanta agreed to a settlement awarding Cop Watch USD40,000.
The lawsuit settlement reaffirms that police aren't allowed to stop citizens from recording in public places.
