NEW YORK — Police Commissioner Raymond Kelly says Officer Alain Schaberger and other officers responding to a domestic violence call in Brooklyn were trying to take a 42-year-old man with a history of domestic violence arrests into custody when he began to resist.

The man had shoved Schaberger over a railing. He fell 9 feet down a cement stairwell, landed on his head and broke his neck early Sunday. He was pronounced dead at Lutheran Hospital.
Charges are pending against the suspect.
